Terms of Service

These Terms of Service (hereinafter "Agreement") govern the relationship between IE Levitsky I. Yu. (hereinafter "Operator") and the user (hereinafter "User") of the "Are You OK?" mobile application (hereinafter "Application").
Important: By using the Application, you confirm that you have read, understood, and agree to the terms of this Agreement. If you do not agree to the terms, please do not use the Application.
1. General Provisions
1.1. The "Are You OK?" Application is designed to provide communication between family members to monitor the well-being of elderly relatives.
1.2. The Application is not a replacement for emergency services (911, 112). In case of threat to life and health, contact the appropriate emergency services.
1.3. The Operator reserves the right to modify the terms of the Agreement. The current version is always available at youokapp.ru/terms-en.html.
2. Service Description
The Application provides the following features:
- Sending "I'm OK" status to family members
- Sending SOS signal with geolocation
- Notifications about relatives' status (push, SMS, Telegram)
- Status check reminders
- Creating and managing family groups
- Widget for quick access to features
3. Registration and Account
3.1. Registration via phone number is required to use the Application.
3.2. The User guarantees that the provided phone number belongs to them and they have the right to use it.
3.3. The User agrees not to share their account credentials with third parties.
3.4. Minimum age to use the Application is 14 years.
4. User Roles
There are two roles in the Application:
- Administrator — creates family group, pays for subscription, invites relatives, configures notification settings
- Tracked User — sends "I'm OK" status and SOS signal, receives reminders
5. User Obligations
The User agrees to:
- Use the Application only for lawful purposes
- Not send false SOS signals
- Not use the Application to stalk or track persons without their consent
- Not attempt to gain unauthorized access to the Operator's systems
- Not distribute malicious software
- Respect the rights of other users
6. Subscription and Payment
6.1. The Application provides a 14-day free trial with full functionality.
6.2. After the trial period, a subscription is required.
6.3. Available plans:
- Basic — up to 2 tracked relatives
- Extended — up to 5 tracked relatives
- VIP — more than 5 relatives (custom terms)
6.4. Payment is processed through App Store or Google Play. Refund terms are determined by the respective platform's policies.
6.5. Subscription renews automatically. Auto-renewal can be disabled in App Store or Google Play settings.
7. Intellectual Property
7.1. All rights to the Application, including design, code, trademarks, and content, belong to the Operator and/or its licensors.
7.2. The User is granted a limited, non-exclusive license to use the Application for personal, non-commercial purposes.
8. Limitation of Liability
8.1. The Application is provided "as is". The Operator does not guarantee uninterrupted operation and is not liable for technical failures.
8.2. The Operator is not liable for:
- Non-delivery of notifications due to reasons beyond the Operator's control (network issues, device settings, third-party actions)
- Actions or inaction of users
- Damages resulting from use or inability to use the Application
- Delays in emergency services response
8.3. The Operator's maximum liability is limited to the amount paid by the User in the last 12 months.
9. Termination
9.1. The User may delete their account at any time through the Application settings.
9.2. The Operator may block the User's account for violation of the Agreement or abuse of Application features.
9.3. Upon account deletion, data is retained for 30 days, after which it is permanently deleted.
10. Dispute Resolution
10.1. All disputes are resolved through negotiation. Claims should be sent to support@youokapp.online.
10.2. Claim review period is 30 calendar days.
10.3. If a dispute cannot be resolved through negotiation, it shall be submitted to the court at the Operator's location in accordance with applicable law.
11. Final Provisions
11.1. This Agreement is governed by applicable law.
11.2. If any provision of the Agreement is found invalid, the remaining provisions shall remain in effect.
11.3. The Operator's failure to exercise any right under the Agreement does not constitute a waiver of that right.
